Question: My apartment building superintendent bled my pipes, the water leaked and caused propety damage. should i get $ books, collectibles, and business papers. Am I correct in wanting compensation for these items.. I took pictures , and kept items as evidence.
Answer: Absolutely if damage caused by negligence of your superintendent, but most of the time, they will brush you off. Best to list out and itemize the damages with cost and give to landlord, and if they don't pay you back, then deduct from the upcoming rent as a final recourse. But most important to document with dates, who you spoke to, damage pictures, make copies of EVERYTHING for your own records. Good luck!

Answer: he or she must have a plumbling, electrical, carpentry background, as well knowledge of building codes, santitation, be able to fix anything. knowledge of various types of tools.

Well, I have apparently rubbed the apartment superintendent the wrong way by complaining about noise too much. The noise levels in the building are completely ridiculous ( people partying outside my window until 3 am on weeknights) but instead of doing anything about it, he;s just branded me a "troublemaker".
Well, some new neighbors moved in last week. I found out from one of them that he had told them that I am "living here illegally" and encouraged them not to listen to anything I say. They decided to have a giant housewarming party on a Monday night, and when I asked at 4 am for them to keep it down, the neighbor who i had never even net started screaming "You live here illegally! You don't have a right to say anything! Im going to call the cops on you!"
Ok, well, I DON'T live in my apartment illegally. New York City housing law says every tenant is entitled to one non-family member as a roommate. I am considered a tenant under the law, with full rights.
Yet that is not stopping him from running around the building and encouraging people to treat me like I'm some squatter in my apartment.
I'm totally pissed about this. Calling the landlord is out of the question (Hes my boyfriend's ex-girlfriend's dad, not on good personal terms!)
Please tell me what I can do legally to get him to stop?

I started calling the police because he wouldn't answer his door or phone at night . Then yesterday he bitched me out for not calling him.
Now he's decided that I'm not even allowed to speak to him and that only my boyfriend can talk to him.
Oh, and BTW, he openly admitted he told the new neighbors this.
Answer: Please site such NYC law. Unless your apartment is rent controlled, rent stabilized or a HUD unit...no such law exists. You may also be violating zoning laws if you live in a studio apartment.

Question: What can I do about the superintendent & landlord of the apartment in which I live ? WARNING : This is kinda long, so please bear with me. :-)
Ok, well, here's the thing ...
The superintendent in my building is abusing his power,
so to speak. What I mean is this... for starters, he sexually
harasses a large group of female tenants, including myself &
my mom. He even goes as far as saying that if we (the female
tenants) don't submit to his advances & resist, that he'll make
sure that we even get evicted. He LOVES to use intimidation.
This goes especially against the female tenants who are physically challenged (mainly in wheelchairs), again myself included. He also gets a sick kick out of blaming my
family & I of breaking things in our apartment just so he'll have the opportunity to come in with his assistant, & while his assistant is actually doing the job, while he thinks nobody's looking, he'll go to wherever area I'm in & try to grope me !!!
I, of course, block his every move 'cause I'm not stupid.
What's worse the landlord doesn't believe any of it
Oh, also, I forgot to mention this (until now, of course). I've also noticed some
other disturbing things.
For example, usually the landlord himself
distributes the rent check in each of the tenants' mailboxes & such.
Well, anyway, this time, however,
I noticed that at first when my mom & I went to check our mailbox, it was still empty. No correspondences. Nothing.
But, then, not even 15 minutes later,
I saw the super reading all the correspondences & later trying to quickly
put in them bak into their respective envelopes quicker than I've seen him move actually doing repairs within the building ! Well, I think you know what I mean.

the police. But, it's like I still wanna do a little more, since the problem with him is so big.
You bet it goes beyond landlord/tenant issues !!! Most definitely !!!

Answer: What you should is video tape everything hes doing and save it and show it to your landlord and if he still do believe you show it to the cops. If they dont do any thing then go to the captain and tell him whats going on and if you cant do it then have someone who can do it and have them tell whats going on.
Question: if your superintendent was not bondable would you allow access to your apartment?
Answer: Not that I'd have much choice, but yes I'd let him in and would try to be there at the time (as even with bondable ones). The guy who fixes what's broken is pretty much the last enemy you want to make in an apartment complex.
Question: Do I have to pay lease termination or other fees if I move out to Section 8 apartment? My friends were approved for Section 8 apartment and moved in before their lease was up. Now previouse apartment complex charging them bunch of fees and for the months that the apartment was empty. They gave almost 60 days notice. They also called superintendent to check apartment before they moved out but he didn't show up. Now they are saying that cabinets are different and bathroom sink is missing. What a mess :(
Answer: Yes, you must pay all fees for breaking the lease. You can be sued in small claims court (if it doesn't exceed the jurisdictional limit) and if the landlord gets a judgment against you, the Housing Authority can terminate the Section 8 benefits.

1)Used to call people 'numbskulls' in notes taped around the
building
2)Fire alarm went off on the ground floor, elevator
automatically stopped on the first floor. Elderly man with
Parkinson's couldn't use it when he came in for his walk. He stood there as the superintendent said 'I can't deal with this now', walked out door
3)Same man had to go without heat for two weeks after Oct 15, which violates elder law!
4)Used to hang underwear, including thongs, on the bulletin board if left in laundryroom
5)Says sexual things to certain women, such as remarking on their backend, or his talks about his priv
6)Pipe leaks in my bathroom, he says it's condensation
7)My stove is a fire hazard, he says it's fine
8)Mows grass once a month
9)Never weeds or cuts down dying plants in fall
10)Wants 2 parking spaces, although only 10.

Answer: I know where to go where I live. There is a place here, in Ontario, Canada, that deals with the rights of tenants - government-run, I think. I'm not sure about where you are, wherever that is. Also, here there is an office where we can get advice for free. We also have free Legal Aid here, and the contact information is in the government section at the end of the phone book. They have pamphlets in the office that you can pick up if you don't want to talk to a lawyer. I hope there are places like that where you live. And of course, your apartment needs to be safe, legally. You may need to contact government to see if you can get inspector/s in.
