Answer: I'm shaky on this, but I believe that you need not identify it as a trademarked product more than once. You do need to capitalize and punctuate it as it is trademarked (i.e., Levi's, Band-Aid), use it as a noun and not a verb (no Googling or Xeroxing), and take pains not to disparage the product in any way, nor place it in a context which is undesirable (porn, bomb-making manuals, whatever).
In general, though, if you can find another term that will do, use it.

Say i do everything for this business, and even have that trademark sign Incorporated into with my name how are we not partners if we do the things partners do...and partners are not permitted to have a contract.

How much is the application (approx.) for a one-person show?
Answer: Trademarks only protect your name in the industry in which you registered it. Thus, you could still get a TM for the same name in a different "class of goods," as the term goes. You do not get your money back if they reject your application. You should speak with an attorney that specializes in trademarks/IP law.
TM application are about $500 bucks, plus you usually have to answer "office actions," which the USPTO will send contesting your mark. It's best to hire an attorney for these.

Answer: No hes trademarked like 8 names lol.
But ive said it before and i'll say it again, four nines is tight.
And about the whole Five Nines thing that the guy after me said - I, for one, have never even heard of Five nines before. and I'm sure that An energy drink would be a lot more common thing for people to be talkign about than computer servers. So I wouldnt throw out the name just because of that.

Answer: Much of the information that is needed in order to apply for copyrights, patents and trademarks in available online, and "search agents" are not needed for most applications.
However, if you do want to pursue this as a career, your best best would be to be employed by a law firm that specializes in that field. Legal training is copyrights, patents and trademarks would be a plus, as trademark law, for example of very different from other areas of commercial law.

Question: Cease and desist letter for trademark infringement w/domains I created. Do I have to transfer them? A real estate developer is starting a new subdivision called "Appleyard" (changed name to protect me). They own the domain www.appleyard.com. I created several domains such as www.myappleyard.com, www.sellappleyard.com, etc.
They do have a legitimate trademark with "Appleyard". They recently sent a cease and desist letter giving me a week to respond and transfer all of the domains I created to them. I want to do the right thing, if I'm wrong I'll transfer them. I want to create real estate sales by acting as a buyer's agent for this new subdivision. These domains were to create some of this business.
Again "Appleyard" is made up, I didn't want to use the actual name here in this public forum. Anyone know for certain if I could keep the domains and sell advertising on it legally?
I normally don't do all caps, but 2 of 3 answers refer to 'Appleyard' as the name in question. IT IS NOT APPLEYARD! I MADE IT UP! I am doing this to protect the identity of the actual domains I created.
Answer: On the face of it, without knowing details, it sounds as if you are infringing. If you were using the name and had a reason other than wanting to piggyback on their name then it would be different. But your purpose is to grab people searching for that property and make a profit off of it.
Whether you have to transfer the domain to them is another matter. I believe you could park it and get whatever you can make from ads. As for your real estate aspirations, I just don't know.
Edit: just wanted to clarify the last sentence. I don't know if you need a good working relationship with these people in order to carry through with your real estate ambitions. More than likely you do. If so, then you may want to voluntarily transfer the domains to them and save them the cost of litigation. You can say something to the effect that you do not believe you were doing anything wrong and that you did not intend to infringe, and in the interest of cooperation, no one will benefit from lengthy litigation - that type thing. Hopefully, you didn't spend much on the registration costs and possibly you might get some goodwill out of it. BTW, common misspellings of the name are bad also.
Whoever designs your website, whether you or someone else, should concentrate on designing it with good SEO principles in mind. That way, even if you cannot use the name as part of your domain, if you have a legit reason to mention it in the text, you should be able to direct a lot of traffic your way.

Answer: I think that as long as you dress it up with a nice non-casual top and makeup & jewelry like you said, you'll be just fine. This might be especially good if you want to look hip and trendy.

Answer: Just to clarify some terminology, you seem to be confusing "acquiring" a trademark with "registering" a trademark. These are two entirely different concepts.
As a general matter, trademark rights are acquired when you use your mark in commerce as a source of a goods or services. Registration is performed only after you have acquired trademark rights through use. Registration may provide a number of important benefits. For example, in the U.S., you generally cannot pursue infringers until you have registered your trademark.
As a practical matter, I seriously doubt you are using your stage name in every country as a source of a goods or services. That is generally reserved for international superstars (I assume you are not yet). Even if you tour around the world, merely using your stage name in performances is likely not sufficient trademark use in order to acquire trademark rights. Also, I get the impression that you think trademark law allows you to monopolize your stage name so that no one else can use it. That is an incorrect understanding of the law.
I strongly suggest you contact an attorney who can discuss your potential rights in detail and in confidence. To be blunt, your understanding of trademark law is fundamentally flawed which is not uncommon.

Answer: I believe its first come first serve with yahoo emails. However if a person is mis-representing himself to be part of your company and using trademarks in his email, you may have a right for legal action. You will need to contact a lawyer for further information.
