Answer: It all depends on the agreement to arbitrate. Typically though, the an arbitrator's decision is not appealable; that's the whole point of arbitration--to avoid the court system. The only way to appeal it would be to show that there was some sort of fraud in the process such as a conflict of interest of the arbitrator that was not disclosed. Even if the arbitratrator based his decision on faulty facts or interpretation of the law, it is not enough for a court to hear the matter.

Answer: Your husband should know. Will he be the General Counsel (the attorney in charge) or is he simply one of the attorneys that works for the General Counsel? Answer: I believe it should be and most states now have free care and it is a basic right, if you walk into any hospital in an emergency they have to treat you.

Answer: Don't listen to riteon who is definitely WRONG! ... and another one with a distorted perception of reality. Unless you can find someone to take the case on a contingency fee basis you may be out of luck completely. Note that there is also a statute of limitations to file against a claim like this. If you miss it, you lose it. Legal aid clinics rarely (and with current legal crisis, never) take these types of cases, so you may have to hunt harder. An option you have is to utilize the Small Claims Court process. You said the damages aren't high enough for an attorney to consider it? It may be the maximum amount for Small Claims Court would compensate somewhat. Think carefully about all your options, not just a few. You can file your own claims in Small Claims Court, and you will get some (a little) assistance with filling out the forms. But you have to do your research and such for yourself. Answer: Legal counsel is an attorney, a Guardian ad litem (spelled litem) is a person who acts on behalf of the best interest of the person, either a child or an incapacitated person, and can be a lawyer. Usually is a lawyer, but there are some agencies who volunteer to be appointed without pay in cases involving children. Answer: As a first offense DUI, with an otherwise clean record, the most she will get hit with is a large fine. She can enter a guilty plea, the judge will ask if she has anything to say. This is where she has a chance to mitigate the fine. She needs to grovel a bit. She apologizes for her lapse in good judgment, point out that she has never done anything this bone head stupid before, that this experience has been embarrassing, frightening, expensive, and will NEVER be repeated again. Public Defenders are not automatically appointed. You have to request one. You only get one if you are too poor to hire your own attorney. If she has a job, owns a car, etc., then she can hire her own lawyer. If it means going into debt, the court does not care. Only the destitute get Public Defenders.
