Question: If your realtor doesn't show for an open house, is that legal grounds for terminating your contract with them? She has basically pushed the selling of our house onto her inexperienced assistant. This person was not in the picture when we signed the contract with her. This assistant showed up late for the first open house, couldn't properly process the sale price for our house on a deal that fell through, and then didn't bother to show up for the second open house. Can we legally terminate our contract with their company?
Answer: Sure sounds like she isn't doing her job. You can't just declare it terminated though. I'd go to the head of that realty office (even if your realtor IS the head) and tell them you want to terminate the contract and tell them why. If they refuse, you'd probably have to get a lawyer and go to court to get it terminated - and by that time, the contract would probably have expired.

Question: How much should I ask for, I want a raise, Legal Assistant/Secretary.? I work in an office as a legal assitant/secretary. I work Mon-Fri from 8-5. I have no benefits. My job duties include but are not limited to... answer phones, make appointments, answer questions, take messages, go to the post office and check the mail daily, go to the bank about 2- 3 times a week. I also go to the court house a few times a week to get files, and file paperwork. I copy the files and open files for the office. I also type and mail the letters to the clients. Dust and vacume the office. I have been on my job for 1 year. I may have taken 4 days off. I do work for family, and sometimes watch their kids when they have late meetings. I also get to pick my son up from school at 3 pm and keep him here in the office with me until 5 pm. Which is why I took the job, now with him in school, it does fit my schedule. I have worked for him for $210. a week, which is enough to pay my bills, but does not leave me any left over. What would be a fair Salary?
There are only 3 people in the office.
Him, the attorney.
His wife, the office manager, she sometimes opens files, but mostly goes to meetings with him.
Myself...the assistant.
It is a Family Law office, so they have to do home visits and school visits with a lot of the Juveniles, and the Department of Children Services. So there are a lot of phone calls, and meetings with parents, foster parents and case managers... Juvenile Justice Case workers...
Answer: Fair??? This is ridiculous...At this rate you are border line minimum wage!
I worked many places as just a secretary and was making minimum 12/hour...(which is 480 a week)
This is a LAW FIRM...You should be making ATLEAST 14/hour.....And again, that is just the minimum...I understand the perks of being able to pick your son up and bringing him to the office...But if you were being paid what you should be, you could easily afford a good daycare or nanny, and still have money left over.
I think when it is time for you to ask for a raise, you should make this point clear...And even with only 1 year experience in a law firm, that is enough to find a great job! You should check out www.craigslist.org.....Check their job section out in the "legal" subject.....
This is the just my advice, and I think you will find that everyone else who answers this will have the same to say...Do not be afriad to ask what you are entitled to. I am sure you're a great worker, and you much deserve this. Do not be afraid of asking to much, give yourself some value

I do not have a paralegal degree yet, it is something that I am looking into. That is why I am only an assistant.
Answer: I make more than that and i am only a receptionist. Most of the legal assistants where i work make about 30 to 60 a year depending on education and experience. Do you have an associates in business/paralegal?
You are saving a ton on childcare expences so that is something to concider.

Considering that you only have 1 year experience and no degree, there arent many people who will want to hire you as a legal assistant. You have to ask yourself, is the money or the experience you will gain more important. Most people want an associates and at least 5 years just for legal assistant.

I work in the East Tenn. Area, outside Knoxville Tennessee. I have looked online, most start out around $28,000. year. He does have quiet a case load, a lot of court appointments.
I know that they can afford to pay me more. They spend more on travel and vacations than I make in a year, or close to it. They are my family, and I am the one going to the bank...so to speak. I just want to know what would be fair. I can say that my only down fall, that I have not been good at is taking the trash out every day... It gets done, just not every single day.

But you only getting paid minimum wage with 210/wk which is like 5.25/hr is boogus you need to go for at least and you will definately be able to get more, most legal positions where i am from make 30,000+ a year or if you are in a small town, go for at least 10.00/per. 5.25 is b.s. people that work in fast food at least make 6.50-8.25/hr.

he took my best friends phone cause she was texting during school hours while he had it a girl took another friend of mines phone and texted the phone that was taken away because she thought it was a guy named oliver ( it was written in the phone oliver instead of olivia) she txted it from a nother guys phone saying " lets **** tonight, my house." (i have no idea why anyone would say such a thing unless they know who they are txting.) so the principle not only looked through all of her stuff before recieving the txt but opened it on a track phone ( wich means you pay as you go, if he had not opened the txt it would not have costed anything. also the ohone was on silent. ) so he opened it and clearly asumed she was talking about having sex with the guy who actually owned the phone. so he came to her class and was like what where you talking about? she said my mile time ( which she was before the other txt.) he said I DONT BELIEVE YOU. and gave her an hour detention. many kids got there phone taken away and looked through. one kid told me its illegal and a 1,000 dollar fee. so is he aloud to look through the phone?
i actualy looked through the california school district code and it said nothing about it.
they are aloud to take it but not look through it

Therefore, I called my tenant and explained my situation asking her that I will need my apartment back, I will give her deposit back with no penalty. But she stated that did not have enough money to rent the other place so I lend her money. She gave me a check as guarantee.. has been a month and she is avoiding my calls. I am taking her to court. Question: House Loan VS house title, how to be fair? Just a curious question:
My friend is not yet marry.. And buy a house together.
Her Bf has his name on the loan and pay more deposit than she is, but her name is not on the loan
He tries to put her name on the title of the house as she will be part of the payment too.
Question is: How hard it is to add her name to the title? What legal assistant is requires?
If they are not together in the future, is she able to have her share, she paid but because his name is on the loan, what happen then?

It is very easy to add her name on title. All they have to do is contact an escrow company and have them draw up a document that costs about $25 to prepare.

Once she is on title, he has to get her authorization to do anything with the house. If in the future her bf wants to sell it, she has to approve of the sale, and once the property sales, she will get her share.

The fact that his name is on the loan means that he is responsible for the mortgage payments. Legally, she is not responsible for making any payments, even if she gets on title. If she gets on title, that does not obligate her to make mortgage payments. So she is actually in a good position if she gets on title because she will own part of the house, but ALL of the responsibility for payments are her bf's.

Question: What is Congress doing about LEGAL IMMIGRANTS WHO ARE STUCK IN ENDLESS BACKGROUND CHECKS? aren't we all entitled to "DUE PROCESS?" but millions of LEGAL IMMIGRANTS are stuck in this very much under-funded FBI program for background checks, many of them for five or more years, even though the processing time frame is ONE YEAR. Afterward, they say you can call the national center every six month for a progress report, which DOES nothing. You can also write to Congressman or Senator, but all they do is ask an assistant to check the progress for you. THERE IS NO END IN SIGHT! THE ONLY OPTION IS TO SUE THE USCIS, WHICH IS NOT A GOOD OPTION because even if you win the lawsuit, it just means they have to process your file, not approve of it(MEANING THEY CAN REJECT IT TO RETALIATE.)
So, with all the outcry of pathway for illegal immigrants, i am wondering what the congress is doing for us LEGAL IMMIGRANTS, who are paying 500 some dollars yearly to apply for work authorization, travel documents, PAY TAXES, ...
