Question: is this a civil or criminal case, when a medical assistant calls in a Rx for a patient and the patient dies? The doctor is not in the office. the patient calls the office complaining of pains, the medical assistant calls a perscription in to the pharmacy. later the patient has a allergic reaction, rushed to the hospital and dies, would this be civil case or a criminal case?
Answer: I think the patient should have gone to the emergency room complaining of the pains. People die, I don't see the correlation between alleged neglect and your person dying. How would the medical assistant know? How would the pharmacist know of an allergic reaction? It's unfortunate, but I wouldn't count on becoming rich.
Question: Can you have a criminal background and still become certified for Dental Assistant in NJ? I kept looking up different institutes etc. to find out tuition and when classes start. Most of them I know ex-felons have gone to (the county's voc-tech schools anyway). But when I went onto UMDNJ's website they said they have to do a criminal background check. Is it the more in-depth programs that are like this or is this for the state of nj period?
Answer: Any medical program does a criminal background. Most likely you cant work at all in the medical field because you deal with private health care information and children.
Question: can you become a classroom assistant with a criminal record ? I was convicted of attempted burglary in 1999 and cautioned, other then that i have committed no crimes
Answer: If it is classed as a "spent" conviction you may be able to, but everybody working with kids has to have a CRB check 1st and it will be up to the people who will be employing you to decide. Good luck.

Answer: Inform your supervising attorney.
Do not go to the Judge or defense attorney with your suspicions. Let the prosecutor handle it.
Question: Can I be an occupational therapy assistant with fighting in public on my criminal record? will the nation board of occupational therapy approve me to get my certification?

Question: what are the criminal background requirements to become a medical assistant?
Answer: Perhaps check with a local association for medical assistants. Please realize, however, that there aren't supposed to be too many jobs for the MA (or medical biller or coder) despite what those private $$ tech schools proclaim. There are so many who've completed a MA program thus causing the field to be saturated and people struggling to find work.

Answer: Not really...lawyers are lawyers, court procedures are typically the same. I work for 5 attys who do ALL types of law...its all the same at the end of the day.
Question: can a person get a dental assistant position with a misdemeanor on their criminal record?
Answer: Yes.
However, if the employee has access to drugs, the dental office manager may do a background check on applicants to ensure that they have not been arrested for drug use, or sales.
If they do, the misdemeanor charge, even if it is not drug related, may show up on the background check.
At that point, it is up to the dental office to decide whether or not they want to hire that person.
Question: if a medical assistant calls in a prescription without the doctors knowledge is it criminal or civil?
Answer: Criminal.
The key here is, "without the doctor's knowledge."
Everything the medical assistant does, (job duties,) is under the direct supervision/authorization of the physician, or physician assistant, especially those duties involving meds.
Trying to, "slip one by," without physician's orders is illegal, period.
Question: WHAT criminal history do they look for n medical assistant and phlebotomy. i have battery,posses and dui in NV? it was about 7 years ago no felonies please help
Answer: Basically, any felonies, which you said you have none, so that is good. Theft, in particular of drugs, and any drug crimes in general, in particular narcotics. The DUI might indicate negligance, but since it was a long time ago and I am hoping only one, it will probably be overlooked. The possession, if it was marijuana, not a big deal, if not, I don't know. Battery, if it's not a felony, it doesn't matter.
