I am concerned for a senior citizen friend who got in over his head with credit card debt he can't pay. He has been told to write to credit card companies and tell them his only income is exempt from collection. Will they place a lien against his property?

Answer: yes and rightfully so == if fact he should make arrangements to dispose of some of this property and take care of his debt!!!

Answer: A clear business plan is essential when you are talking about your idea to anyone critical. You properly need to be absolutely clear what you are going to do in the first place and then to persuade some important people, either private or governmental to invest or donate into your project.

Question: Looking for a Florida law stating a senior citizen's telephone cannot be terminated when all charges were pd,? I NEVER signed up for Onebill giving them the right to manage my wireless bill. They added charges. My standing with Verizon wireless (brought in Indiana long before I went to Florida) is excellent. Verizon Flordia has not only terminated my phone there, but also turned me over to a collection agency. I must have a land line. I am a serior citizen with health issues. Help please.

Answer: I am a Florida resident and I am not aware of any statute giving senior citizens special protection in such circumstances.

Question: Any ideas on how I should handle contesting a parking ticket from my college? Three years ago, my senior year of college, I parked in front of one of the buildings to drop a paper off. When I came out, 5 minutes later, I had a ticket. I got in my car, started to drive out of the lot, and I noticed I had a flat tire, so I pulled back in the spot I was in, and put the ticket back on my car. I called AAA to come fix the tire. I went back in the building to wait for AAA, when I came back out, I had ANOTHER ticket on my car! I think this is ludicrous of the officer to do this. I did not pay the tickets and now my school is sending out a collection agency to get the money. After all I paid them to go to school there, they want more. Any ideas on how I can contest the second ticket?? I am willing to pay for half, but the second ticket is ridiculous. Thanks for any useful help!

Answer: Paying your tuition has nothing to do with illegal parking. It may have been ridiculous then, but I'm sure the humor is long gone since now it is in the hands of a collection agency. Contact the agency, and explain why you don't feel it's fair to pay the second ticket, then get your check book ready. They care as much now, as you cared then.

Question: Senior Pictures photo montages? Hi! I just wondered if you guys knew of a website with a collection of photo montages to do with senior pictures. To be honest I'm not even sure if they are called "photo montages" I just mean those pictures that have like 3 - 4 pictures of the same person and you can put their name in a corner, etc... like a recompilation of a few pictures so they create a big one. I was thinking I wanted to do that for my mom, but I can't find any! If I just had the border, like the picture itself, I would fill in the spaces myself with photoshop. Any idea?

Question: Am I right when it comes to a collections agency being on my credit report? My senior year in high school I played football and injured my knee and so I had to get surgery on it and now there is collections agency coming up on my credit report showing an unpaid balance for which the schools insurance was to finish paying for. Is it legal for it to come up on my credit report even though I was under the age of 18 at the time this happened or does that even matter at all when it comes to this? FYI My bday was in June of 2003 and the collections agency put that on my credit report on July of 2003 right after my highschool graduation and my 18th bday (YES, I KNOW IT'S NOT A LOT BUT I DON'T WANT TO BE RESPONSIBLE FOR SOMETHING THAT WASN'T MY FAULT TO BEGIN WITH)

Answer: First you need to obtain validation of the debt from the collections agency. In their validation, it will show the date the debt was incurred. If this date is BEFORE your 18th birthday..........send a copy of the validation and your birth certificate to the credit bureau along with your DISPUTE of the entry on your credit file. The Credit Bureau should immediately delete this entry from your file, or they can be sued for $1,000.00 for violation of the Fair Credit Reporting Act, and the Fair Deb Collection Act. Good Luck.

Question: In the state of Texas does the court allow bank account garnishment in judgment cases? We have a collection agency who filed suit on a car we let go back. They sold the car and this is the balance. We offered half of what they are sueing for but they did not accept. Now they are sueing and we fear they will win a default judgment. We are afraid they will be able to garnish our checking account. We are both senior citizens and can not afford what they are requiring to be paid

Answer: BANKRUPTCY PROPERTY EXEMPTIONS (Texas Revised Civil Statutes Annotated): First, in most cases, a creditor can not get a writ of garnishment without first going to court and getting a judgment against you. Once a creditor has a judgment he may use what is called a writ of garnishment to get money or property that you are "owed" by another person. For example, when you put money in a bank account the bank has an obligation to return that money to you. In effect, they are a debtor and owe you the money. A creditor with a writ of garnishment may garnish these funds and take them to satisfy the judgment. Your best bet would to open a checking account in another state. Texas law only provides garnishment in banks registered in Texas. Out of state banks are exempt. If your income is from Social Security, SSDI, or VA compensation, then those funds can not be garnished.
